Terms of Service

1. Acceptance of Terms

By accessing or using Splatial ("Service"), including our website at splatial.com and our Apple Vision Pro application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Splatial is operated by SideResult Software ("we", "us", "our"). The Service allows users to generate immersive 3D environments from text or image prompts and experience them on Apple Vision Pro.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

3. Account Registration

To access certain features, you must sign in using Sign in with Apple. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access.

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Attempt to gain unauthorized access to the Service or its related systems
• Use automated means to access the Service except through our provided API
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service in any manner that could damage, disable, overburden, or impair it
• Resell, redistribute, or sublicense access to the Service without our written consent

5. AI-Generated Content

The Service uses third-party AI technology provided by World Labs to generate 3D environments ("Generated Content"). You acknowledge that:

• Generated Content is created by AI and may not always be accurate, appropriate, or as expected
• When using the shared API key, Generated Content may be visible to other users of the World Labs platform
• When using your own API key (available via in-app purchase), Generated Content is subject to World Labs' own terms and privacy policy at worldlabs.ai
• We do not claim ownership of your Generated Content, but we reserve the right to remove content that violates these Terms
• You are responsible for any content you submit as input (text prompts or images) for generation

6. Third-Party Services

The Service relies on third-party technology, including but not limited to:

• World Labs — AI world generation (subject to their Terms of Service and Privacy Policy)
• Apple — Sign in with Apple authentication and in-app purchases

We are not responsible for the availability, accuracy, or practices of any third-party services. Your use of such services is governed by their respective terms.

7. In-App Purchases

Certain features of the Service may require in-app purchases processed through Apple's App Store. All purchases are subject to Apple's terms and conditions. We do not process or store payment information directly. Refunds are handled through Apple's standard refund process.

8. Safety & Immersive Experience

Splatial provides fully immersive experiences on Apple Vision Pro that block your view of the real world. You acknowledge and agree that:

• You are solely responsible for ensuring your physical safety while using immersive experiences
• You should be seated in a safe, clear area before entering an immersive world
• You should be aware of your physical surroundings at all times
• We are not liable for any injury, damage, or loss resulting from use of the immersive features
• You should not use the Service while driving, operating machinery, or performing any activity that requires your full attention

9. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by SideResult Software and protected by copyright, trademark, and other intellectual property laws. The MetalSplatter rendering engine is used under open-source license from its respective author.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIDERESULT SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

12. Account Suspension & Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
